Candidate Privacy Notice
General
The service for handling recruitments and simplifying the hiring process (the "Service") is powered by Teamtailor on behalf of Huel. This notice describes how Huel collects and uses personal information about you in accordance with the General Data Protection Regulation (GDPR) and applicable laws. You are being sent a copy of this privacy notice because you are applying for work with us. It makes you aware of how and why your personal data will be used, namely for the purposes of the recruitment exercise, and how long it will usually be retained for. It provides you with certain information that must be provided under the GDPR and/or applicable laws.
This notice applies to candidates based at the following locations:

Huel is a "controller" in relation to personal data. This means that we are responsible for deciding how we hold and use personal information about you. For candidates based in the United Kingdom, the data controller of your personal information is Huel Limited. For candidates based in the United States, the data controller of your personal information is Huel Inc. For candidates based in Germany, the data controller of your personal information is Huel GmbH.

GDPR Principles
We will comply with data protection law. This says that the personal information we hold about you must be:
Used lawfully, fairly and in a transparent way.
Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.
Relevant to the purposes we have told you about and limited only to those purposes.
Accurate and kept up to date.
Kept only as long as necessary for the purposes we have told you about.
Kept securely.
The kind of information we hold about you
In connection with your application for work with us, we may collect, store, and use the following categories of personal information about you:
Full name, maiden name, title.
Personal email address.
Address.
Telephone number.
Employment history.
Qualifications.
Right to work in the UK, US or Germany (as applicable).
Criminal records information (in the event an offer is made and only for specific roles).
Any information that you provide to us in your application form, curriculum vitae and covering letter.
Any information that you provide to us during an interview.
How your personal information is collected
We collect personal data about users of the Service when users:
make an application through the Service or otherwise, adding job-specific personal data about themselves either personally or through publicly available information on third-party source(s) such as Facebook or LinkedIn;
use the Service to connect with our staff, adding personal data about themselves either personally or through publicly available information on third-party source(s) such as Facebook or LinkedIn; and
provide identifiable data in the chat (provided through the website that uses the Service) and such data is of relevance to the application procedure.
We collect publicly available data from third parties, such as Facebook, LinkedIn and through other public sources. This is referred to as “sourcing” and is manually performed by our employees.
In some cases, existing employees can make recommendations about potential applicants. Such employees will provide personal data relating to such potential applicants. In the cases where this is made, the potential applicant is considered a user in the context of this privacy notice and will be informed about the processing.
How we will use information about you
We may use the personal information we collect about you for the following purposes and on the following legal bases:
Assess your skills, qualifications, and suitability for the role.
Carry out background and reference checks, where applicable.
Communicate with you about the recruitment process.
Keep records related to our hiring processes.
Comply with legal or regulatory requirements.
It is in our legitimate interests to decide whether to appoint you to the role since it would be beneficial to our business to appoint someone to that role.
We may sometimes use your personal data because we have a recognised legitimate interest. Where we rely on a recognised legitimate interest, we will ensure the use is strictly necessary and only use or share the minimum data required.
We also need to process your personal information to decide whether to enter into a contract of employment with you.
For candidates in the US, we do not rely on the legal bases or legitimate interests described above. Instead, our use of your personal information in the hiring process is governed by applicable US federal and state employment, privacy and related laws governing categories of information we collect and use in connection with your application.
Having received your application form, curriculum vitae and covering letter, we will then process that information to decide whether you meet the basic requirements to be shortlisted for the role. If you do, we will decide whether your application is strong enough to invite you for an interview. If we decide to call you for an interview, we will use the information you provide to us at the interview to decide whether to offer you the role. If we decide to offer you the role, such offer shall be conditional as we will then take up references and conduct background checks before confirming your appointment.
If you fail to provide personal information
If you fail to provide information when requested, which is necessary for us to consider your application (such as evidence of qualifications or work history), we will not be able to process your application successfully. For example, if we require a credit check or references for this role and you fail to provide us with relevant details, we will not be able to take your application further.
How we use particularly sensitive personal information

Huel does not discriminate on the basis of race, color, religion, sex, national origin, age, disability, genetic information, sexual orientation, gender identity or expression, marital status, familial status or any other characteristic protected by applicable federal, state or local law. Candidates with disabilities are encouraged to apply. In the event you disclose any particularly sensitive personal information, such information will be handled in the following ways:
We may use sensitive personal information provided, including information about your disability status, strictly to provide reasonable accommodations to qualified individuals in accordance with applicable laws.
Information about criminal convictions
· Where we have made you a conditional offer of employment for certain roles, we may carry out a criminal record check as part of our post-offer / pre-employment screening where we consider such a check to be necessary and proportionate for the role in question. We process criminal conviction data on the basis of Article 6(1)(f) UK GDPR (legitimate interests) and in accordance with Article 10 UK GDPR, read together with the applicable condition under Schedule 1, Part 1 to the Data Protection Act 2018 (the specific condition relied upon will depend on the nature of the role in question).
Automated decision-making
As part of the recruitment process, we may use a third-party psychometric testing provider to carry out personality and behavioural profiling of candidates. The purpose of this assessment is to evaluate characteristics relevant to job performance. This may involve sharing your name and email address with the provider and your responses to assessment questions as applicable. The results of such testing may be used alongside other information gathered during the recruitment process to inform decisions as to whether you progress to the next stage of the recruitment process or are offered a role. Any results generated through such testing are always subject to human review and are not used as the sole basis for any recruitment decision. We rely on our legitimate interests (Article 6(1)(f) GDPR) as the legal basis for this processing, namely our interest in assessing candidates' suitability for the role alongside other information gathered during the recruitment process.
You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making.
Sharing Personal Data
We may transfer your personal data to:
IT and technology service providers, including the provider of the Service, cloud storage, HR systems and communication platforms, acting as our processors and sub-processors in accordance with our instructions;
recruitment and assessment platform providers, including the provider of the Service and psychometric testing providers, acting as our processors in accordance with our instructions;
background check and screening providers, where applicable to the role, acting as our processors in accordance with our instructions;
other entities within the Huel group, including Huel Limited, Huel Inc and Huel GmbH, for the purposes described in this privacy notice;
regulators, law enforcement and other governmental authorities, whether in connection with suspected criminal or improper behaviour or as otherwise required by applicable law; and
authorities or professional advisers, including legal advisers, auditors and insurers, where necessary for the purposes of obtaining professional advice or as otherwise required by law or an authority’s injunction.
Any third parties that we transfer your personal data to are required to take appropriate security measures to protect your personal data in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.
We may share aggregated data with third parties. The aggregated data has in such instances been compiled from information that has been collected through the Service and can, for example, consist of internet traffic statistics or users’ geographical locations. The aggregated data does not contain any information that can be used to identify individual persons and is therefore not ‘personal data’.
International Transfers
When we share your personal information outside the UK or EU, we put in place appropriate measures to ensure that your personal information is treated by those companies in a way that is consistent with and which respects the UK and EU laws on data protection.
Your personal data may be transferred to, and processed in, countries other than the country in which you are based. In particular, your personal data may be transferred to other entities within the Huel group, including Huel Limited (United Kingdom), Huel Inc (United States) and Huel GmbH (Germany), for the purposes described in this privacy notice. Huel has entered into intragroup data transfer agreements to govern the transfer of personal data between Huel group entities. Your personal data may also be transferred to, or onward-transferred by, third-party service providers in countries outside the UK or EU. As set out in the "Sharing Personal Data" section above, all such third parties are required to take appropriate security measures to protect your personal data and may only process it for specified purposes in accordance with our instructions.
Where your personal data is transferred to a country that has not been deemed to provide an adequate level of data protection by the relevant authority, whether by us or by a third party acting on our behalf, we will ensure that appropriate safeguards are in place to protect your personal data. Such safeguards include reliance on adequacy decisions, the UK International Data Transfer Agreement (UK IDTA), the UK Addendum to the EU Standard Contractual Clauses, EU Standard Contractual Clauses (EU SCCs), or other lawful transfer mechanisms as required under the applicable data protection legislation.

Data security
We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need-to-know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality. Further details of these measures are available upon request.
We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.
Third parties will only process your personal information on our instructions and where they have agreed to treat the information confidentially and to keep it secure.
Data retention
We will retain your personal information for a period of 12 months. We retain your personal information so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way. After this period, we will securely destroy your personal information in accordance with our data retention policy and applicable laws and regulations.
If we wish to retain your personal information on file, on the basis that a further opportunity may arise in future and we may wish to consider you for that, we will write to you separately, seeking your explicit consent to retain your personal information for a fixed period on that basis.
Cookies
Information about your usage of the Service may be stored as cookies. Cookies are passive text files that are stored in the internet browser on devices such as computers, mobile phones or tablets. We use cookies to secure, maintain and improve the Service and to gather information about its usage. Instances where information collected through the cookies constitutes personal data are regulated by our Cookie Policy.
At any time, you can disable the use of cookies by changing the local settings in your device. Disabling cookies can affect the experience of the Service, such as by disabling some functions within the Service.
Candidates’ rights in connection with personal information*
Under certain circumstances, by law you have the right to:
Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
Request the transfer of your personal information to another party.
If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact the Data Protection Officer at dataprotectionofficer@huel.com.
Right to Object and Withdrawal of Consent in the EU/UK
Most personal information processed in connection with your application is processed on the basis of our legitimate interests, pre-contractual steps, or legal obligations. Where we rely on legitimate interests, you have the right to object by contacting the Data Protection Officer at dataprotectionofficer@huel.com. We will cease the relevant processing unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms, or the processing is necessary for the establishment, exercise or defence of legal claims. If you wish to withdraw from the recruitment process, please notify the Data Protection Officer at dataprotectionofficer@huel.com. We will cease processing your personal information for recruitment purposes and, subject to our retention policy, securely dispose of your personal data. In the EU/UK, where we have obtained your explicit consent for a specific purpose, such as retaining your information for future roles, you may withdraw that consent at any time by contacting the Data Protection Officer at dataprotectionofficer@huel.com. Withdrawal of consent will not affect the lawfulness of processing carried out prior to its withdrawal.
*For candidates based in the United States, the following rights shall apply:
· Right to inspect and copy personnel file contents (where applicable under state law);
· Right to receive notification of certain data collection practices;
· Right to submit concerns or questions about data handling to dataprotectionofficer@huel.com;
· Right to accurate records under applicable federal and state law
In addition, the following rights may apply depending on applicable law.
· Right to know the categories and specific pieces of personal information collected;
· Right to correct inaccurate personal information;
· Right to delete personal information, subject to legal retention requirements;
· Right to opt-out of sale or sharing of personal information (if applicable);
· Right to limit use of sensitive personal information.
Complaints
You have the right to make a complaint at any time to the relevant data protection authority in your territory, though we would appreciate the opportunity to address your concerns first. If you are in the UK, you also have the right to make a complaint to us directly if you consider that we have not complied with our obligations under the UK GDPR. Any such complaint may be directed to the Data Protection Officer at dataprotectionofficer@huel.com.
